"Horsetrucksforrent.com" is a private limited company registered in the Trade Register under number 32101590 and is hereinafter referred to as HTFR.
"You" refers to the customer (main driver) who has signed the rental agreement and is authorized to operate the Vehicle. For clarity, "you" refers to the main driver, the person who pays for the rental and/or the person who books the Vehicle. Please note that although "you" may refer to multiple persons, we enter into an agreement with all parties, but can only speak about a confirmed booking with the main driver.
"Vehicle" is the horse truck that HTFR or another rental company – as indicated at the time of booking – rents to you, for the agreed duration of the rental agreement, and also refers to all parts and accessories attached to it at the start of the rental.
"Damage" is all damage to the Vehicle (including windows, lights and mirrors), and – if applicable – all damage to third-party property.
"Our Terms" apply to all agreements for the delivery of our services, to the exclusion of all other terms. No action by HTFR may be construed as acceptance of any other terms. Acceptance of the services or signing of an agreement shall be deemed sufficient proof of your acceptance of these terms. We may change the terms from time to time, and we recommend that you visit the website to check whether the terms applicable to you have changed.
Accuracy of information. While we strive to ensure the accuracy of the information on this website, neither we, nor our affiliated companies, suppliers or representatives are liable for the accuracy of this information. It is solely your responsibility to assess the accuracy, completeness and usefulness of all information provided on this website.
We are – among other things – not liable when someone drives under the influence of alcohol/drugs, deliberately or consciously recklessly causes damage, or drives on unpaved terrain or without the required care and attention. You accept full responsibility with respect to related claims.
Our rental platform can also be used by third parties to rent Vehicles, such as other rental companies or (private) individuals.
Terms of your agreement with HTFR. The moment you confirm this verbally or click "Book Now", you make us an offer to purchase the services. We accept this offer as soon as we have both received the necessary payment. If we act as a representative of a rental company or person, we accept your offer as a representative of that rental company or person, if the Vehicle is rented through our partners. When we act as a representative, this is clearly indicated at the time of booking. Subject to such notice at the time of booking, HTFR rents the Vehicle to you. The same rules apply, regardless of whether the Vehicle is rented directly from HTFR or from another rental company or person. When an agreement has been entered into in any way, HTFR always has the right to withdraw its offer or agreement within 5 days after the day of payment. In case of bankruptcy or any other circumstance whereby you cannot control your own assets for any period of time, HTFR is free at all times to terminate the agreement concluded with you with immediate effect, without being obliged to pay any compensation.
In case of conflicts between the provisions in the agreement between you and HTFR and our Terms, the provisions in the agreement shall apply first, otherwise our Terms shall apply. In case of dissolution or termination of this agreement or any provision therein, the remaining provisions shall continue to apply. If the remaining provisions are not legally valid as a result of this annulment, these provisions must be renegotiated.
HTFR is not liable for obvious errors and typos in the agreement.
Liability HTFR. We are only responsible for direct damage that you suffer as a direct result of our breach of this agreement, namely if the damage is a foreseeable consequence of our breach of the agreement. Damage is foreseeable when it could be expected by both you and us at the time our agreement was concluded. In any case, we are not responsible for indirect damage that occurs as a side effect of the main damage and that was not foreseeable for you and us, and also not liable for – without any limitation – loss of profit, missed opportunities or loss of goodwill, or consequential damage, compensation or expenses. In the event that we would still be liable, the damage is in any case limited to a maximum amount of €5,000.
Limitation period. Any claim and other powers of you towards HTFR, on any grounds whatsoever, shall lapse in any case after the expiry of six months from the moment when an event occurs that allows you to use these rights and/or powers against HTFR and you have not instituted legal proceedings at that time.
Website terms of use. It is prohibited to use a device or software program to communicate directly or indirectly with this website for the purpose of retrieving content and/or other data, including prices, or to attempt to do so. It is also prohibited to disrupt the normal operation of this website, or to attempt to do so. Any activity that, in our opinion, excessively loads or pressures our systems will be terminated. We continuously monitor everyone who visits our website, and activities of automated systems or persons who perform an unreasonable number of searches for the purpose of gaining access to information and/or prices will be terminated, and the relevant systems/persons will be denied further access to our websites. By using the website, you agree to these terms of use.
Customer reviews. Completed reviews may – for the sole purpose of informing customers about your opinion on the service and quality of the rental company – be posted on our website, and used by HTFR in whole or in part for the benefit of our platforms, social media, newsletters, special promotions, mobile applications or other channels owned by, managed, used or controlled by HTFR. By submitting a review, you consent to the above use thereof. We reserve the right to modify, refuse or remove reviews at our discretion. Reviews reflect the personal opinion of HTFR customers who have completed a survey after the end of the rental period. These opinions do not necessarily reflect the views of HTFR.
Complaints. If you are not satisfied with the rental, you must report this immediately, and in any case within 3 days after discovering the complaint, by contacting our head office. After this period, HTFR or the rental company or person is in any case not liable for any damage whatsoever. It is difficult for us to assess a claim relating to your rental if it is not reported immediately after discovery. If you rent a horse truck from a rental company for which HTFR acts as a representative, we will try to help in case of a problem by contacting the rental company on your behalf.
Personal Data Protection Act. We point out that HTFR collects a number of personal data in the context of the execution of the booking and rental process. You are required to provide all requested information; failing that, HTFR cannot properly insure the booking and/or the rental. You have the right to view, update, correct or delete personal data collected by us. You can correct factual inaccuracies in that data by sending us a request pointing out the error. The data will only be used for the professional purposes of the rental process.
In order to enable us to provide you with services effectively, HTFR may from time to time transfer collected data to other companies inside or outside the EU. This transfer does not entail any limitation, and our privacy policy remains fully applicable. By accepting these General Terms and Conditions, you authorize HTFR International to proceed with such a transfer.
Transfer of rights and obligations. HTFR is permitted to transfer the rights and obligations described in any agreement with you to third parties. You yourself are not entitled to transfer your rights and/or obligations under this agreement to any third party without the prior written consent of HTFR.
Driver's license. You must possess a driver's license that is valid in the country where the rental takes place, and be able to show it. Expired or provisional driver's licenses are not accepted. You must also carry the driver's license with you during the entire rental period so that local authorities can check it.
No refund will be made if a rental company refuses to provide a horse truck due to unlisted endorsements, or because you are unable to present a driver's license or equivalent, or the required information about endorsements. We are not liable for completing the journey, nor for any refund, compensation or other costs you may have to pay in such a case.
Please note: if you are driving abroad, you may need an international driver's license. It is the driver's responsibility to determine whether they need an international driver's license. An international driver's license does not replace a regular driver's license: a full driver's license in the name of the main driver remains required to rent the horse truck, and every driver who needs an international driver's license must carry both documents at all times. The international driver's license is only valid if accompanied by the regular driver's license. If an international driver's license is required, you cannot pick up your Vehicle without the international driver's license and your regular driver's license.
When the rental takes place outside the country where you live, you must also present a valid identity card or valid passport. Although these identity documents are generally not requested if you live in a member state of the European Union and the rental takes place in another member state of the European Union, each case is assessed separately.
Payment. You must show a valid payment card with an expiration date after the latest check-in date or a valid HTFR payment card when picking up.
More details can be found in section 3 – Payment Terms.
Confirmation of your reservation takes place (in most cases) immediately, via the email address you provided during the reservation. When you book the horse truck through our website, we will send you an email within 48 hours after the reservation (or – if this is earlier – at least 24 hours before your pick-up time) to confirm availability. We will then send you a reservation confirmation. You will only receive your agreement after we have confirmed your booking and received payment. We send all correspondence to the address provided during the reservation.
In most cases, the following cancellation terms apply to your reservation. If the reservation is cancelled within 48 hours before the time of your reservation, you will be charged 50% of the total reservation price. If the reservation is cancelled within 24 hours before the time of your reservation, you will be charged 100% of the total reservation price. In case of emergency (horse cannot participate in a competition, competition cancelled, etc.), you must provide convincing proof thereof, such as a statement from a veterinarian/clinic about an injury, or other proof of an emergency that could not have been foreseen in advance. The assessment of the emergency situation is always up to an HTFR employee, and is never up for discussion.
When a horse truck is returned late (after the agreed time), and especially after the closing time of the pick-up company (5:00 PM), the system automatically charges an extra day. This may result in the next customer not receiving the horse truck at the right time.
In case of a so-called "no show", the amount you paid will not be refunded. A "no show" occurs when:
Modifications (changes to your booking) – you can make changes to your booking at any time before the horse truck needs to be picked up. No administrative fees are charged for changes to your booking, but the changes you make may affect the rental price. Sometimes (not often) we can only change a booking by cancelling it and creating another one. In that case, we may charge you cancellation fees on behalf of the rental company.
If you wish to keep the Vehicle for a longer period than originally specified in the rental agreement, you must first contact HTFR's main number by telephone to extend the duration of the rental agreement. The Vehicle is insured for the period specified in the rental agreement. Unless otherwise agreed in writing by HTFR, the contracting party remains liable to HTFR for any damage after the expiry of this period.
If we make changes to your booking: From time to time it may be necessary for us or the rental company to make changes to your booking (after acceptance). In all these cases, we will inform you as soon as reasonably possible before picking up the horse truck, and if the proposed changes are unacceptable, you will be offered a full refund. In such cases, however, we are not liable for any direct or indirect damage you suffer as a result of such changes.
If the horse truck cannot be picked up because the documentation is insufficient or because a valid credit card cannot be presented, this is treated as a "no show", which means you are not entitled to a refund of payments made.
Delivery and pick-up conditions. You undertake to deliver the Vehicle at the agreed place, date and time indicated in the rental agreement. If you ask HTFR, and HTFR agrees in writing, to deliver or pick up the Vehicle, you may be charged additional costs and may need to follow additional instructions. You should check this at the time of booking. Please note: rental companies or persons are generally not willing to deliver or pick up a Vehicle at a private address.
You must deliver the Vehicle immediately upon request by HTFR. If the Vehicle is not delivered to HTFR upon request, you hereby authorize HTFR to enter your property and do whatever is necessary to repossess the Vehicle. You are liable for all costs incurred in connection with such repossession. HTFR may repossess any Vehicle without prior notice or liability if this is necessary according to HTFR for its own protection.
Driving areas. Restrictions may apply if you take the Vehicle to another country/state/island. Therefore, if you intend to do so, you must report this to our Contact Center at the time of booking. For travel to certain countries, additional documentation may be required, and local costs may be charged.
The total costs for each rental are determined based on the price list applicable at the time of rental. If you do not meet the conditions for a contractual rate, the standard rate must be paid.
You must show a valid payment card with an expiration date after the applicable check-in date or a valid HTFR payment card when picking up.
Please note: HTFR accepts commonly used payment methods, such as various credit cards, iDeal and Apple Pay, but since not all payment card companies are represented in all countries, it is advisable to check in advance whether a particular card is accepted. Payment cards are accepted up to the limits permitted by the company behind the payment card. It is in no case possible to pay in cash.
When the Vehicle is returned, the invoiced amount will be charged to the specified credit card, unless you provide another payment method.
If payment is not made by the due date stated on the invoice at the latest, you will receive a total of two official reminders, including administrative costs and/or collection costs. If no action is taken on your part, your case will be transferred to the collection agency. From that moment, that agency is responsible for all further actions regarding your case. All associated (additional) costs are at your expense. Moreover, you are obliged to pay the statutory (commercial) interest from the due date of the invoice until the moment of payment.
If payment is not made by the due date of any invoice, or any other form of default, all outstanding invoices are immediately payable, and HTFR is entitled to demand immediate return of all Vehicles still rented at that time and to terminate the agreements relating to this rental.
The rates applicable to the rental, ancillary services and optional coverage or insurance are the rates in force on the date of issue of the rental agreement, and correspond to the characteristics you originally indicated at the time of booking (in terms of Vehicle type, duration, return location...). An appropriate alternative rate will need to be charged for any change in characteristics.
If the Vehicle is not returned with a full fuel tank, the missing amount of fuel and refueling will be charged to you, according to the rates applicable in the country of rental. The costs may be higher than at a local gas station.
The Vehicle must be returned clean. To clarify the condition of the horse truck: the horse section must be completely free of animal droppings, hay, straw or sawdust upon return. This can easily be achieved with a broom. Additional hosing down or using a pressure washer is greatly appreciated, but is never mandatory. If the above-mentioned waste is present, a cleaning fee of at least €50.00 excluding VAT will be charged. If the actual cleaning costs are higher than the fee, the actual additional costs will also be charged to you. The HTFR employee who checks the Vehicle upon return is fully responsible for assessing the condition of the horse truck, and for making a final decision on whether or not to charge the fee. The cab of the Vehicle must also be clean upon return, which means that there should be no dirt or animal hair on the seats and floor covering, and the glove compartments and storage compartments must be free of waste. Otherwise, the same costs will be charged.
Your own risk in case of damage is a maximum of €1,000.00 excluding VAT, unless there is intent or conscious recklessness or other circumstances caused by you, whereby the insurer does not provide (full) coverage, in which case the actual damage will be recovered.
All horse trucks are insured on the basis of European insurance, and are therefore not suitable for driving outside the European Union. If you must drive outside Europe, you must discuss this with the HTFR service center before the trip, whereby HTFR has the right to still refuse to perform the agreement.
Damage caused by your horse to the inside or outside of the Vehicle is not covered by the insurance, and is therefore your own financial responsibility. In case of an accident, you must inform HTFR immediately.
IMPORTANT NOTE: Damage to the undercarriage and/or roof resulting from a collision with a bridge, tunnel, overhanging structure, etc. is not covered, unless force majeure can be demonstrated.
Liability for damage to the Vehicle, theft or conversion. You are liable for all possible damage suffered by HTFR in connection with the Vehicle entrusted to you. This means that in case of theft of or damage to the Vehicle, you must fully indemnify HTFR (whereby the compensation will be equal to at least the repair costs, the resale value of the Vehicle, the costs of loss of use, administrative costs and other ancillary costs). The compensation for repair costs will not exceed the market value of the rented Vehicle at the time of the incident.
You are advised that any waivers on your part lapse if you fail to take reasonable measures for the safety of the Vehicle or its parts or accessories, fail to comply with all restrictions on the use of the Vehicle, or otherwise misuse or misuse the Vehicle.
In case of damage to the vehicle and/or third parties as a result of a traffic accident, whether or not caused by your fault, you are obliged to fill in an official damage form and, if necessary, have the police draw up an official report. In case you refuse or fail to fill in the damage form without a valid reason, the full damage amount (without taking into account the deductible) can be charged to you.
In case of breach of contract, you are liable to HTFR. This means that you are responsible for all financial damage that HTFR suffers as a result of such a breach of contract and all related third-party claims. You agree to pay all costs that HTFR incurs in enforcing these terms.
HTFR, its officers, directors or employees are not liable to the contracting party for any amounts whatsoever, nor for any proceedings, lawsuits or claims relating to direct or indirect damage, consequential damage or punitive damages (such as loss of business or loss of profit) arising from or related to the rental or use of a Vehicle, regardless of whether the proceeding is based on a contract or a tort. You indemnify HTFR against all claims, liabilities, damages, losses or expenses arising from the rental and/or use of the Vehicle and you indemnify HTFR against all third-party claims.
If the damage suffered by HTFR subsequently turns out to be lower (because the Vehicle can be repaired within 60 days, or due to partial or full liability of the third party), you will receive the corresponding refund.
Minor damage. Both at check-out and at check-in, HTFR, together with you, will record all visible minor damage to a Vehicle in the rental agreement. At check-out, unrepaired damage must be noted in the rental agreement, with the correct signatures from you and HTFR. At the end of the rental period, i.e. at check-in, any new minor damage identified must be added to the rental agreement. Any new minor damage must be reported to HTFR immediately, noted in the rental agreement, and signed by you and HTFR. Any damage that has not been recorded at check-in is considered new damage, for which you are liable. The costs incurred by HTFR in connection with this damage (repair costs and other costs related to the incident) will be charged to you.
These repair costs are invoiced directly to you by HTFR and include the costs of damage repair, as well as administrative costs, immobilization costs, the costs of parts and labor costs. The above-mentioned invoiced repair costs are due under the same conditions as the payment under the rental agreement.
Even in the case where HTFR acts as an intermediary for a rental company or person, the damage settlement will run through HTFR and HTFR will be entitled to collect (damage and/or repair) claims.
Condition of the vehicle. A description of the condition of the Vehicle will be handed to you together with the rental agreement. Before you leave the rental location, you must check the condition of the Vehicle. If a clear defect is identified that has not yet been noted in the document, you must immediately notify the HTFR employee at the counter so that the Vehicle can be inspected together. In such a case, the document must be adjusted and signed by both parties. If the amended document has not been signed by both parties, the condition of the Vehicle as indicated in your rental agreement applies, and it is assumed that you received the Vehicle in good working order. You must return the Vehicle in the same condition as it was delivered at the beginning of the rental period. You are responsible for any repair or refurbishment costs, which will be added to the rental price.
Use of the Vehicle. The Vehicle may only be driven by you, and only on condition that your driving ability is not impaired in any way by a mental or physical limitation or prohibited by law.
Each Vehicle has a special GPS system from Moving Intelligence with which we can determine the location of the horse truck. By applying these General Terms and Conditions, you give us permission to check the location of the horse truck at any time. This will only take place for safety reasons, such as for mileage monitoring and detailed tracking of the Vehicle.
If you wish to take the Vehicle outside the country of rental, you must check whether this is permitted according to the General Terms and Conditions of HTFR and, if necessary, request prior written consent from HTFR. If in doubt, always contact us.
The Vehicle will be delivered to you with a full fuel tank. You may only refuel the Vehicle with the correct type of fuel. As indicated in Article 3, if the Vehicle is not returned with a full tank, the costs for fuel and refueling are at your expense.
You are liable for all costs, taxes, fines and penalties incurred and imposed in connection with the use of the Vehicle and charged to HTFR, unless these have arisen through the actions of HTFR. These costs will be passed on to you (possibly with an additional charge for administrative costs).
During the rental period, you must perform the checks usual for every careful user (oil level, tire pressure, etc.), and you must – if applicable – adhere to the Vehicle's maintenance cycle as stated in the maintenance guide. When warning lights come on, you must immediately notify HTFR and consult whether you can continue driving.
You undertake to lock the Vehicle when you park it – regardless of whether this is only for a short time – and to use the alarm and/or immobilization equipment of the Vehicle. You may under no circumstances leave the Vehicle unattended and/or unlocked and/or with the keys in the ignition. Failure to return the keys will result in invalidation of the theft coverage.
You undertake to use the Vehicle in a responsible manner and, in particular, only for the purposes for which it is intended.
In particular, it is not permitted to use the Vehicle under any of the following circumstances or for any of the following purposes:
For any criminal offense committed during the rental period and in some way related to your use of the Vehicle, you are just as liable as if you were the owner of the Vehicle. At the request of the police or an official authority, HTFR may be required to transfer your personal data. Such a transfer takes place in accordance with the data protection laws of the country of rental.
The agreement between you and HTFR and all disputes arising from it are exclusively governed by Dutch law. If Dutch law is not applicable due to mandatory law, the law of the country of the location where the Vehicle is picked up applies. Any disputes relating to the agreement will be decided by the competent court in the Netherlands.
